Terms of Service

These Terms of Service ("Terms") govern your use of Trackara Pro, a business management application for mobile mechanics and auto repair professionals, operated by Commoner Apps LLC ("Commoner Apps," "we," "us," or "our"). By downloading, installing, or using Trackara Pro, you agree to these Terms.
1. Acceptance of Terms
By creating an account and using Trackara Pro, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with these Terms, do not use the Service.
Electronic Agreement and Consent
When you create an account, you must affirmatively agree to these Terms of Service and our Privacy Policy by checking the agreement checkbox during registration. This electronic acceptance constitutes a legally binding agreement equivalent to a handwritten signature.
For legal compliance and your protection, we record the following information when you accept these Terms:
- Timestamp: The exact date and time of your acceptance
- Terms Version: The version number of the Terms of Service you agreed to
- Privacy Policy Version: The version number of the Privacy Policy you agreed to
- Device Information: Your device model, operating system, and version
- App Version: The version of Trackara Pro used during acceptance
This information is stored securely and may be used to verify your acceptance in case of disputes. You may request a copy of your terms acceptance record by contacting support@trackara.app.
2. Description of Service
Trackara Pro is a mobile application that provides business management tools for mobile mechanics and auto repair professionals, including:
- Client and vehicle management
- Invoice and quote generation
- Work order creation and digital signatures
- Time and labor tracking
- OBD2 vehicle diagnostics via Bluetooth adapters (trouble code scanning, real-time engine metrics, and diagnostic reporting)
- VIN decoding and vehicle specification lookup
- Route optimization for multi-stop service days
- Mileage tracking for business expense and tax deductions
- Appointment scheduling and customer booking portal
- Maintenance task management and service reminders
- Vehicle inspection templates and reports
- Blueprints and procedure templates for standardized workflows
- Community marketplace for sharing procedures and documentation
- Business analytics and reporting
- Cloud synchronization (optional)
The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue features at any time with reasonable notice.
3. Account Registration and Eligibility
Age Requirement
You must be at least 18 years old to use Trackara Pro. The Service is intended for business and professional use.
Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Providing accurate and current information
4. Subscription and Payment
Subscription Plans
Trackara Pro offers the following subscription options:
- Monthly: $49.99 USD per month, auto-renewing
- Annual: $499.99 USD per year, auto-renewing (save over 15%)
Canadian Users: Pricing is shown in USD. Apple App Store will handle currency conversion to CAD at checkout based on current exchange rates.
Free Trial
Trackara Pro does not currently offer a free trial period. You will be charged immediately upon subscribing. Subscription begins upon purchase confirmation.
Auto-Renewal and Consumer Protection Rights
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You will be charged for renewal within 24 hours before the current period ends.
California Residents: Pursuant to California SB-340 (automatic renewal law), you have the right to:
- Receive clear notice that your subscription will automatically renew
- Cancel your subscription at any time through iPhone/iPad Settings → Apple ID → Subscriptions
- Receive a confirmation email after subscribing (sent by Apple)
- Be reminded of your subscription renewal before being charged (managed by Apple)
Canadian Residents: Pursuant to the Competition Act and provincial consumer protection laws, you have the right to:
- Receive clear disclosure of subscription terms and auto-renewal before purchase
- Cancel your subscription at any time through iPhone/iPad Settings → Apple ID → Subscriptions
- Receive confirmation of your subscription and renewal terms
- Request a refund within the applicable timeframe under provincial law (contact Apple Support)
By subscribing, you acknowledge and agree that your subscription will automatically renew and you will be charged the then-current subscription price unless you cancel. You may cancel at any time without penalty through Apple's subscription management.
Payment Processing
Payments on the iOS app are processed through Apple's In-App Purchase system. Web subscriptions purchased at pro.trackara.app are processed by Stripe, Inc. on Stripe-hosted payment pages. In both cases, Trackara Pro does not store or process your credit card information directly.
Price Changes
We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect existing subscribers until their next renewal cycle.
Cancellation
You may cancel your subscription at any time through your iPhone/iPad Settings → Apple ID → Subscriptions (iOS) or by contacting support@trackara.app (web). Cancellation takes effect at the end of the current billing period. No refunds for partial periods.
Refunds
All sales are final. Refunds for iOS subscriptions are handled by Apple according to their refund policy. Refund requests for web subscriptions can be submitted to support@trackara.app and are reviewed on a case-by-case basis.
Failed Payments and Non-Payment Suspension
If a scheduled subscription payment fails (for any reason, including insufficient funds, expired card, or declined transaction), the following automated process applies to web subscriptions:
- Grace period. Your account enters a seven (7) day grace period beginning on the date of the first failed payment attempt in a billing cycle. During this time, you retain full access to the Service.
- Notifications. You will receive automated email notifications describing the failed payment and the steps required to resolve it. Our payment processor (Stripe) will also continue to automatically retry the charge on your behalf.
- Automatic suspension. If the payment is not successfully resolved before the grace period ends, your account will be automatically suspended without further notice. Suspended accounts cannot access the Service until payment is restored.
- Data retention during suspension. We do not delete your data when your account is suspended for non-payment. All records — projects, invoices, quotes, clients, work orders, and other content — are retained on our servers.
- Automatic reactivation. Once a successful payment clears, your account is reactivated automatically and you can resume using the Service immediately.
- Extended non-payment. If an account remains suspended for non-payment for more than ninety (90) days, we reserve the right to treat the account as terminated and apply the data deletion timeline described in Section 13 (Termination).
You remain responsible for any outstanding charges, including amounts that accrued during the grace period. By subscribing, you authorize Stripe to retry failed charges using your payment method on file in accordance with card network rules.
Inactive Signups
If you create a Trackara Pro account but do not complete payment activation within fourteen (14) days of account creation, the following automated process applies:
- Reminder notifications. You will receive up to two automated email reminders during the fourteen-day window encouraging you to complete payment setup. Reminders are transactional in nature and relate solely to the account you created.
- Automatic dormancy. If payment is not activated within fourteen (14) days, your incomplete account will be marked as dormant, you will receive one final notification, and we will stop further communications related to that signup.
- Data scope. Dormant signups hold only the basic profile information you submitted at registration (name, email, business name, contact details, location). No subscription has been formed, no charges have been made, and no business data has been created.
- Returning later. You may sign up again at any time using the same email address. Reactivation of a dormant account, or creation of a new account, is at our discretion.
5. Acceptable Use
Permitted Use
You may use Trackara Pro for legitimate business purposes related to auto repair and mobile mechanic services.
Prohibited Activities
You agree NOT to:
- Use the Service for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Share your account with others
- Reverse engineer, decompile, or attempt to extract source code
- Use automated systems or bots to access the Service
- Interfere with or disrupt the Service or servers
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to other users' accounts
- Use the Service to send spam or unsolicited communications
- Impersonate another person or entity
6. User Content and Data
Your Data
You retain all rights to the data you create in Trackara Pro (client information, invoices, work orders, etc.). We do not claim ownership of your business data.
Data Responsibility
You are solely responsible for:
- The accuracy and legality of your data
- Maintaining backups of important information
- Compliance with applicable privacy laws when storing client information
- Obtaining necessary consent from clients for data collection
License to Us
You grant us a limited, non-exclusive license to store, process, and transmit your data solely for the purpose of providing the Service (e.g., cloud sync, backups, displaying your content within the app). We will not use your data for any other purpose without your explicit consent.
User-Generated Content License
If you participate in community features, forums, marketplace listings, or share content with other users (such as guides, templates, or parts listings), you grant us and other users a non-exclusive, royalty-free license to use, display, and distribute that content within the Trackara Pro ecosystem. You retain ownership of your content but agree to allow others to view and use publicly shared materials.
Content Restrictions
You agree that any content you share publicly will not:
- Infringe on intellectual property rights of others
- Contain false, misleading, or fraudulent information
- Violate any applicable laws or regulations
- Include malicious code, viruses, or harmful materials
- Promote illegal activities or dangerous automotive practices
User-Imported Reference Materials (Service Manuals and PDFs)
Trackara Pro includes a feature that lets you import PDF files (such as service manuals, wiring diagrams, technical service bulletins, and other automotive references) onto your device for viewing within the app.
- Your representations. By importing any file, you represent and warrant that you own the file or have all necessary rights, licenses, and permissions to use it in this way, including any rights required under the copyright laws of your jurisdiction.
- Device-only storage. Imported files are stored only on your local device. We do not upload, host, index, scan, transmit to our servers, or redistribute imported files. They are not backed up to iCloud or Google Drive by the app.
- No review or approval. We do not review, pre-approve, or inspect imported content. We have no knowledge of what files you choose to import.
- Your responsibility. You are solely responsible for any content you import and for removing any file for which you do not have the necessary rights. If a rights-holder contacts you with an infringement claim, you must remove the file from your device.
- No sharing facilitated. The app does not provide a share or export function for imported files in order to discourage redistribution.
External Reference Links
The app may surface deep-links to third-party reference websites (for example, public repair-information sites) as a convenience. We do not operate those sites, we do not guarantee their content, and your use of them is subject to their own terms and policies. If you are a publisher or rights-holder and believe the app is improperly linking to infringing content on a third-party site, contact us at support@trackara.app with "External Reference Complaint" in the subject line and we will, in good faith, review and may remove or disable the affected link at our discretion.
7. Device Compatibility
Trackara Pro is designed for iPhone, iPad, and Android devices running supported versions of iOS, iPadOS, or Android. By using the Service, you acknowledge:
- Features and functionality may vary between devices and platforms
- We do not guarantee identical performance across all supported devices
- Some features may require specific hardware capabilities (camera, GPS, etc.)
- You are responsible for ensuring your device meets minimum system requirements
- Performance may be affected by your device's available storage, memory, and iOS version
8. Third-Party Services and Integrations
Trackara Pro integrates with various third-party services to provide functionality. By using the Service, you acknowledge:
Third-Party Service Providers
- Apple iCloud: For data synchronization across your devices
- Google Firebase: For authentication, cloud storage, analytics, and push notifications
- NHTSA (National Highway Traffic Safety Administration): For VIN decoding and vehicle specification data
- Apple StoreKit: For subscription and payment processing
- Apple MapKit and CoreLocation: For route optimization, geocoding, driving directions, and mileage tracking
- Apple CoreBluetooth: For OBD2 diagnostic adapter connectivity
Third-Party Service Disclaimer
We are NOT responsible for:
- The availability, uptime, or reliability of third-party services
- The accuracy of data provided by third-party APIs (including VIN data and recall information)
- Changes to third-party service terms, pricing, or functionality
- Data loss or service interruptions caused by third-party providers
- Security breaches or vulnerabilities in third-party systems
Your use of third-party services through our app is also subject to those services' own terms and privacy policies.
9. Cloud Services and Data Storage
If you enable cloud synchronization:
- Your data is stored on Apple iCloud and Google Firebase
- Data is encrypted in transit and at rest
- You can disable cloud sync at any time in settings
- Cloud data is retained for 30 days after subscription cancellation

10. Intellectual Property
Our Rights
Trackara Pro, including all software, designs, text, graphics, logos, and other content, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service.
Trademarks
"Trackara Pro" and associated logos are our trademarks. You may not use our trademarks without prior written permission.
11. Disclaimers and Limitations of Liability
Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
No Professional Advice
Trackara Pro is a business tool and does not provide legal, tax, accounting, or professional advice. Consult appropriate professionals for business decisions.
Vehicle Safety and Liability Disclaimer
IMPORTANT AUTOMOTIVE SAFETY NOTICE: Trackara Pro is a business management and documentation tool only. It is NOT a substitute for professional automotive training, certification, or expertise. We provide NO warranties, representations, or guarantees regarding:
- The accuracy, completeness, or reliability of vehicle diagnostic codes (OBD2 data)
- VIN decoding information or vehicle specifications
- Parts compatibility, fitment, or safety for specific vehicles
- Repair procedures, torque specifications, or service recommendations
- The safety or roadworthiness of any vehicle serviced using this app
USER RESPONSIBILITY: You are solely responsible for:
- Ensuring all automotive work is performed safely and correctly according to manufacturer specifications and industry standards
- Verifying all diagnostic codes, parts information, and technical data independently
- Complying with all applicable safety regulations, emission standards, and legal requirements
- Obtaining proper training, certifications, and licenses required in your jurisdiction
- Using appropriate safety equipment and following industry best practices
WE DISCLAIM ALL LIABILITY for vehicle damage, personal injury, death, property damage, or any other harm arising from automotive work performed by you or documented through this app. Automotive repair is inherently dangerous and you assume all risks.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
Data Loss
While we implement reasonable security measures, we are not responsible for data loss, corruption, or unauthorized access. You are responsible for maintaining your own backups.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your business data or client information
13. Termination
By You
You may terminate your account at any time by canceling your subscription and using the "Delete Account" feature in the app (Settings → Account → Delete Account), or by contacting support@trackara.app to request account deletion.
By Us
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- Your payment fails or subscription expires (see Section 4 for the specific non-payment suspension workflow, including the 7-day grace period and automated reactivation)
- We are required to do so by law
- We discontinue the Service (with 30 days' notice)
Effect of Termination
Upon termination:
- Your access to the Service will be revoked
- Local data on your device remains accessible
- Cloud data is deleted after 30 days (unless you request immediate deletion)
- You remain responsible for any outstanding payments
14. Copyright and DMCA Policy
Copyright Infringement Claims
We respect intellectual property rights. If you believe content shared by another user infringes your copyright, please submit a DMCA takedown notice to our designated copyright agent with the following information:
- Your physical or electronic signature
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material and its location in the app
- Your contact information (name, address, telephone, email)
- A statement that you have a good faith belief the use is unauthorized
- A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

Counter-Notification
If you believe your content was wrongly removed, you may submit a counter-notification to the same address with:
- Your physical or electronic signature
- Identification of the removed material and its former location
- A statement under penalty of perjury that the material was removed by mistake or misidentification
- Your consent to jurisdiction of federal court in your district
Repeat Infringer Policy
We will terminate accounts of users who are repeat copyright infringers.
15. Marketplace and Community Features
Parts Marketplace
If you use marketplace features to buy or sell automotive parts:
- Buyer-Seller Relationship: Trackara Pro is a platform only. We are NOT a party to transactions between buyers and sellers. All sales are between users directly.
- No Warranty: We make no representations about the quality, safety, legality, or accuracy of parts listings. Verify all information independently.
- Seller Responsibilities: Sellers are responsible for accurate descriptions, legal compliance, shipping, taxes, and customer service.
- Buyer Responsibilities: Buyers are responsible for payment, verifying parts compatibility, and ensuring purchases are legal in their jurisdiction.
- Prohibited Items: No stolen goods, counterfeit parts, recalled items, or illegal products. Violation results in immediate account termination and reporting to authorities.
Fraud Prevention and Reporting
To report fraudulent marketplace activity, stolen parts, counterfeit goods, or scams:
- Email: support@trackara.app with subject "Marketplace Fraud Report"
- Include: screenshots, listing URLs, user information, description of fraudulent activity
- We will investigate within 48 hours and take appropriate action including account suspension and law enforcement reporting
User Disputes
Disputes between users (payment issues, quality disputes, shipping problems) must be resolved directly between the parties. We may provide user contact information to facilitate resolution but are not responsible for mediating or resolving disputes.
16. Force Majeure
We shall not be liable for any failure or delay in performance of our obligations under these Terms due to events beyond our reasonable control, including but not limited to:
- Acts of God (earthquakes, floods, fires, natural disasters)
- War, terrorism, civil unrest, or government actions
- Internet or telecommunications failures
- Third-party service provider outages (Apple, Google, Firebase)
- Cyberattacks, hacking, or security breaches affecting infrastructure
- Pandemics, epidemics, or public health emergencies
During such events, our performance obligations will be suspended for the duration of the force majeure event. We will make reasonable efforts to mitigate the impact and resume normal operations as soon as possible.
17. Changes to Terms
We may modify these Terms from time to time. We will notify you of significant changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the modified Terms.
18. Governing Law and Dispute Resolution
Governing Law
United States Users: These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.
Canadian Users: These Terms are governed by the federal laws of Canada and the laws of the province in which you reside, without regard to conflict of law principles. Disputes will be subject to the jurisdiction of the courts in your province of residence.
Arbitration (United States Users)
For United States users, any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.
Arbitration Opt-Out (United States Users)
United States users may opt out of the arbitration agreement by sending written notice to support@trackara.app within 30 days of first using the Service. Your notice must include your name, email address associated with your account, and a clear statement that you wish to opt out of arbitration. If you opt out, you and Trackara Pro agree to resolve disputes exclusively in the state or federal courts of California.
Canadian Dispute Resolution
Canadian users are not subject to binding arbitration. Any disputes will be resolved in the courts of your province of residence. You have the right to pursue claims in small claims court or through applicable provincial consumer protection tribunals.
Class Action Waiver (United States Users Only)
United States users agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits. This waiver does not apply to Canadian users, who retain all rights under Canadian law including class action participation where applicable.
19. Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
No Waiver
Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision.
Assignment
You may not assign or transfer these Terms or your account. We may assign these Terms to an affiliate or successor.
